Private Investigations is split roughly into two sphere's, being Factual Enquiries and Surveillance. Each of these split into more specialist sub-groups. These are not neat distinct groups, however, with quite a lot of investigations requiring skills drawn from across the range. To complete a file the Private Investigator may require surveillance, on ground enquiries, affidavit or statement taking, physical recording of evidence on video or still images, research and occasionally the use of specialist in different forensic sciences or fields of law.

The biggest difference between a Lawyer or Solicitor and a Private Investigator is the method of operation, when preparing to deal with your Criminal, Civil or Family Law matter. Investigators get out and about to find evidence, gather versions of events in affidavit or statutory declaration form, record the contributing conditions and look for evidence to support your version of events, or any dangers to your case. They are able to conduct surveillance to establish breaches of duty or obligation, before court. Private Investigators gather the evidence to establish facts, which then permits the legal team to get a witness to commit to a version, before offering evidence that they are an unreliable witness or the reality is different to their stated position. Lawyers, Solicitors and Barristers tend to focus on the theatre of court and how to deal with information presented to them, we prepare the information.
Court is a theatre, where everyone has their part. We are there to prepare you for your court or tribunal hearing. You must remember that just being in the right is not enough. Courts are bound by precedent (The Australian High Court not as much). Some courts are equity courts, such as the Family Law Court, where there is an attempt to balance the needs of all sides. We can be regarded as a resource that works for the client, not a government agency. We are not obliged, generally, to reveal information on things we find in the course of our investigations, unless it is in the client's interest and with the clients permission.
