Process Server is the generic name given to a person who serves court documents. Court documents are generally served as a way of advising or notifying of an occurrence or process.
It is a legal process that utilises the services of a mercantile agent, commercial agent, licensed operative, licensed investigator or other designated person, authorised under state law to conduct the procedures.
Not all documents in all jurisdictions must be served by a process server. One example of this is an Application for Divorce, also known as divorce papers. However, it is recommended that they are served by a process server, to ensure that the legislative requirements are met.
Generally the process of service includes the supply of an acknowledgement, or Oath of Service. These take different forms in different jurisdictions.
